Upper Tribunal Applies UK GDPR To Clearview AI

The Upper Tribunal ruled that UK GDPR can apply to US-based Clearview AI for processing images of UK residents, overturning a 2023 First-tier Tribunal conclusion and finding such processing related to monitoring or offering services to UK individuals. The court clarified behavioural monitoring includes passive automated profiling, sent the case back for rehearing, and granted permission to appeal to the Court of Appeal in December 2025.
